Terms of Service

1. Acceptance of Terms

By accessing or using VirtualSMS ("Service"), operated by VirtualSMS ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Service Description

VirtualSMS provides SMS verification services using real physical SIM cards. Our platform allows users to receive one-time passwords (OTPs) and verification codes for legitimate account registration and verification purposes. We also offer number rental services for dedicated long-term use.

3. Eligibility

You must be at least 18 years of age to use this Service. By using VirtualSMS, you represent that you are of legal age in your jurisdiction and have the capacity to enter into a binding agreement.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You may NOT use VirtualSMS to:

• Create fraudulent accounts or engage in identity theft
• Conduct spam campaigns or mass unsolicited messaging
• Violate any applicable local, national, or international law
• Bypass fraud detection systems in a manner that causes harm to third parties
• Resell or redistribute our services without prior written authorization
• Automate excessive requests that degrade service performance for other users

5. Payments and Refunds

VirtualSMS accepts cryptocurrency payments. All deposits are non-refundable except in cases where a purchased number fails to receive any SMS within the stated timeout window, in which case the activation cost is automatically refunded to your account balance.

Account balances do not expire. However, accounts inactive for more than 24 months may be subject to closure, with any remaining balance forfeited after 30 days' notice.

6. Pay-Per-Success Model

Verifications are charged only upon successful SMS delivery. If no SMS is received within the verification window, you will not be charged. Rental numbers are charged upfront for the agreed rental period regardless of SMS volume received.

7. API Usage

API access is provided for legitimate integration purposes. You are responsible for securing your API keys. Rate limits apply to prevent abuse. Excessive automated requests may result in temporary or permanent suspension of your account.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted access. Maintenance windows, technical issues, or events beyond our control may result in temporary service disruption. We are not liable for losses arising from service interruptions.

9. Termination

We reserve the right to suspend or terminate accounts that violate these Terms without prior notice. Upon termination for violation of these Terms, any remaining account balance may be forfeited. Users may close their own accounts at any time by contacting support.

10. Limitation of Liability

To the fullest extent permitted by law, VirtualSMS shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability to you for any claims arising from use of the Service shall not exceed the amount you paid us in the 30 days preceding the claim.

11. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify users of significant changes via email or platform notification.
