Terms of Service

By accessing or using VirtualSMS ("Service"), operated by VirtualSMS ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

VirtualSMS provides phone-number and messaging infrastructure using real physical SIM cards. Depending on your account and product selection, the Service may include:

• One-time SMS verifications (OTP / activation codes) for legitimate account registration and verification
• Dedicated number rentals for longer-term inbound SMS
• Residential proxy bandwidth and related network products where offered
• Browser session infrastructure where offered
• Developer access via REST API, webhooks, Telegram bot, and MCP server integrations for humans and automated agents
• Affiliate and referral programs where you opt in

You are responsible for ensuring your use complies with the terms of any third-party platform or service you verify against.

You must be at least 18 years of age to use this Service. By using VirtualSMS, you represent that you are of legal age in your jurisdiction and have the capacity to enter into a binding agreement.

You agree to use the Service only for lawful purposes. You may NOT use VirtualSMS to:

• Create fraudulent accounts or engage in identity theft
• Conduct spam campaigns or mass unsolicited messaging
• Violate any applicable local, national, or international law
• Bypass fraud detection systems in a manner that causes harm to third parties
• Resell or redistribute our services without prior written authorization
• Automate excessive requests that degrade service performance for other users
• Use proxies or sessions to attack, scan, or compromise third-party systems

VirtualSMS is a prepaid balance service. Deposits are credited to your account balance via payment methods shown in the deposit flow at the time of payment — currently including cryptocurrency (processed by our payment partner) and, where available, bank instant-payment rails such as Russia's SBP (Система быстрых платежей), also processed by a third-party payment provider. Supported cryptocurrencies, networks, minimum amounts, and fiat rails may change without notice; the deposit screen is authoritative. We do not store payment card or bank credentials on our servers.

Deposits to your account balance are generally non-refundable except where stated below or required by law. Activation charges are automatically refunded to your balance when a purchased number fails to receive any SMS within the stated timeout window (typically within 20 minutes). Rental and other prepaid products are charged upfront for the agreed period unless otherwise stated at purchase.

Account balances do not expire while your account remains active. Accounts inactive for more than 24 months may be subject to closure, with any remaining balance forfeited after 30 days' notice.

Verifications are charged when the Service successfully delivers the SMS to your order. If no SMS is received within the verification window, you are not charged for that activation. Rental numbers and other fixed-term products are charged upfront for the agreed period regardless of SMS volume received.

API keys, MCP server access, and Telegram bot usage are provided for legitimate integration and automation. You are responsible for securing credentials and for all actions taken under your account. Rate limits apply to prevent abuse. Excessive automated requests may result in temporary or permanent suspension.

We strive for high availability but do not guarantee uninterrupted access. Maintenance windows, technical issues, or events beyond our control may result in temporary service disruption. We are not liable for losses arising from service interruptions.

We reserve the right to suspend or terminate accounts that violate these Terms without prior notice. Upon termination for violation of these Terms, any remaining account balance may be forfeited. Users may close their own accounts at any time by contacting support.

To the fullest extent permitted by law, VirtualSMS shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability to you for any claims arising from use of the Service shall not exceed the amount you paid us in the 30 days preceding the claim.

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify users of significant changes via email or platform notification.
